This information is important because the Cemetery Board has decided that it does not have the authority to issue a regulation requiring cemeteries under its jurisdiction to distribute copies of a cemetery’s rules, regulations, prices and charges except immediately prior to purchase of cemetery property. At present, a single copy must be placed in a conspicuous location in the cemetery office. You can obtain a copy of the price list for the actual cost of printing.
Our pamphlet attempts to help the consumer obtain accurate information while we work to have the law changed so that it requires cemeteries to make this information available in writing to any interested person. Feel free to copy and share the pamphlet.
As a consumer you can exercise your right to obtain information before entering into a contract. If a cemetery refuses to show you the Cemetery Board approval for a cemetery rule, regulation, price or charge that seems unreasonable, you may wish to leave the cemetery office and file a Freedom of Information Law (FOIL) request for the information with the Division of Cemeteries, 123 William Street, 20th floor, NYC, NY 10038-3804 or Division of Cemeteries, 41 State Street, Suite 1110, Albany, NY 12231-0001 The Freedom of Information Law can be found at: www.dos.state.ny.us/foil2.html
